Ticket Purchase Terms of Sale

Below is the ticket purchase policy for S4 Sports and Entertainment, Inc. d/b/a S4 Sports d/b/a The Snow League (“S4 Sports)”. Please read carefully before proceeding. If you purchase tickets to our events, you agree that you have read and agree to be bound by the following terms and conditions. Tickets to S4 Sports events grant a revocable license to attend the designated event. This license may be revoked at any time for any reason at the sole discretion of S4 Sports or its partners. Tickets may not be resold or transferred for commercial purposes without prior written consent from S4 Sports. Unauthorized resale, including resale above face value, may result in ticket cancellation without compensation. Treat tickets like cash. Customers are responsible for safeguarding their tickets. Lost, stolen, or damaged tickets will not be replaced under any circumstances. Anyone who uses a S4 Sports ticket agrees to the provisions set forth in these Ticket Purchase Terms.

Admission Requirements. To gain entry, each attendee must present a valid, original, undamaged, and unaltered ticket at the venue at the scheduled time. Admission may be denied for any reason, including but not limited to misconduct, intoxication, violation of venue rules, or failure to comply with event policies, as determined solely by S4 Sports. Attendees must comply with all health and safety protocols established by S4 Sports or the venue, including screenings, security checks, or other requirements. Failure to comply may result in denial of entry without refund.

No Refunds or Exchanges. All ticket sales are final. No refunds, cancellations, or exchanges will be provided, except as expressly stated herein. Discounts or promotions may be offered after the original on-sale date, but S4 Sports will not issue refunds or credits for price differences.

Event Cancellation or Changes.

Cancellation: If an event is canceled, refunds of the base ticket price may be issued at S4 Sports’ discretion. Refund requests must be made within 10 business days of the scheduled event date.

Rescheduling: If an event is rescheduled, the original tickets will remain valid for the new date. Refunds for rescheduled events will be issued only if authorized by S4 Sports and must be requested before the rescheduled event occurs. All refund requests must be made within 10 business days of the new event date.

Weather: Attendees assume all risks related to inclement weather, including event delays or modifications. S4 Sports reserves the right to proceed, postpone, or modify events based on weather conditions.

Recording and Conduct Policy. The use of cameras, video recording devices, or any recording equipment is strictly prohibited at S4 Sports’ events unless expressly authorized. Violation of this policy may result in ejection from the event without refund. Additionally, disruptive or inappropriate conduct, as determined by S4 Sports, will be grounds for removal from the venue.

Personal Information. By purchasing tickets, attending events, or interacting with S4 Sports, you acknowledge and agree that any information collected by S4 Sports or its partners in connection with your purchase, attendance, or participation will be used in accordance with S4 Sports’ Privacy Policy, which is available at https://www.thesnowleague.com/privacy-policy. The Privacy Policy explains how we collect, use, share, and protect your information, including any personal data, and outlines your rights regarding the information you provide.

Filming, Recording, and Appearance Release. By attending events organized by S4 Sports, you acknowledge and agree that the event may be filmed, recorded, or photographed for broadcast, livestream, marketing, archival, or other purposes. By entering the event premises, you grant S4 Sports and its affiliates, partners, licensees, and assigns the irrevocable right to: (a) record and capture your likeness, image, voice, actions, and statements in any format, including but not limited to video, audio, and photography and (b) use, reproduce, display, distribute, and otherwise exploit such recordings or images for any purpose, including but not limited to marketing, advertising, promotional materials, broadcasts, livestreams, and archival purposes, in any media now known or hereafter developed, worldwide, and in perpetuity. You waive any right to inspect or approve any materials incorporating your likeness and release S4 Sports and its affiliates from any claims, including but not limited to claims for compensation, invasion of privacy, or rights of publicity, arising out of the use of your image, likeness, or voice as described herein. If you do not wish to be filmed or photographed, you should not attend the event.

By purchasing a ticket or attending any event organized by S4 Sports, you agree to indemnify, defend, and hold harmless S4 Sports, its affiliates, employees, agents, officers, and directors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: your attendance at the event; your violation of any event rules, terms, or policies; your breach of these terms; or your conduct at the event. Your obligations under this indemnity survive the conclusion of the event.

Limitation of Liability. To the maximum extent permitted by applicable law, S4 Sports assumes no liability or responsibility for any personal injury or death or property damage or loss o of any whatsoever resulting from your purchase of a ticket to or attendance of any S4 Sports live event. In no event shall S4 Sports, its affiliates, agents, directors, employees, suppliers, or licensors be liable to you for any claims, proceedings, liabilities, obligations, damages, losses or costs exceeding the greater of (i) the total amount you paid for tickets to the specific event or (ii) $100.00. This limitation of liability section applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if S4 Sports has been advised of the possibility of such damage. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This Agreement gives you specific legal rights, and you may also have other rights which vary from state to state. The disclaimers, exclusions, and limitations of liability under this Agreement will not apply to the extent prohibited by applicable law.

Read this section carefully because it requires the parties to arbitrate their disputes and limits the manner in which you can seek relief from S4 Sports. These terms and any disputes arising hereunder shall be governed by the laws of the State of Connecticut, without regard to its conflict of laws principles. For any dispute with S4 Sports, including without limitation any dispute or claim related to or arising in connection with your purchase of a ticket to or attendance of any S4 Sports live event, you agree to first contact us at contact@thesnowleague.com and attempt to resolve the dispute with us informally. In the event that we have not been able to resolve a dispute with you after sixty (60) days, we each agree to resolve any claim, dispute, or controversy (excluding any claims for injunctive or other equitable relief as provided below) arising out of or in connection with or relating to this Agreement, or the breach or alleged breach thereof (collectively, “Claims”), by binding arbitration by JAMS, under the Optional Expedited Arbitration Procedures then in effect for JAMS, except as provided herein. JAMS may be contacted at www.jamsadr.com. The arbitration will be conducted in Fairfield County, Connecticut, unless you and S4 Sports mutually agree otherwise, and the state and federal law applicable in Fairfield County, Connecticut will apply. If you purchase a ticket for or attend any S4 Sports live event for commercial purposes, each party will be responsible for paying any JAMS filing, administrative and arbitrator fees in accordance with JAMS rules, and the award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys’ fees and reasonable costs for expert and other witnesses. If you are an individual purchasing a ticket for or attending any S4 Sports live event for non-commercial purposes: (i) JAMS may require you to pay a fee for the initiation of your case, unless you apply for and successfully obtain a fee waiver from JAMS; (ii) the award rendered by the arbitrator may include your costs of arbitration, your reasonable attorney’s fees, and your reasonable costs for expert and other witnesses; and (iii) you may sue in a small claims court of competent jurisdiction without first engaging in arbitration, but this does not absolve you of your commitment to engage in the informal dispute resolution process. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Section shall be deemed as preventing S4 Sports from seeking injunctive or other equitable relief from the courts as necessary to prevent the actual or threatened infringement, misappropriation, or violation of our data security, Intellectual Property Rights or other proprietary rights.

Class Action/Jury Trial Waiver. With respect to all persons and entities, regardless of whether they have obtained or used the Service or purchased a ticket for or attended any S4 Sports live event for personal, commercial or other purposes, all Claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class action, collective action, private attorney general action or other representative proceeding. This waiver applies to class arbitration, and, unless we agree otherwise, the arbitrator may not consolidate more than one person’s Claims. You agree that, by entering into this Agreement, you and S4 Sports are each waiving the right to a trial by jury or to participate in a class action, collective action, private attorney general action, or other representative proceeding of any kind.
