Ticket Purchase Terms of Sale

Below is the ticket purchase policy for S4 Sports and Entertainment, Inc. d/b/a The Snow League (“The Snow League)”. Please read carefully before proceeding. If you purchase tickets to our events, you agree that you have read and agree to be bound by the following terms and conditions and to the terms set forth in our Privacy Policy. - Tickets. Tickets to The Snow League events grant a revocable license to attend the designated event. This license may be revoked at any time for any reason at the sole discretion of The Snow League or its partners. Tickets may not be resold or transferred for commercial purposes without prior written consent from The Snow League. Unauthorized resale, including resale above face value, may result in ticket cancellation without compensation, where permitted by law. Treat tickets like cash. Customers are responsible for safeguarding their tickets. Lost, stolen, or damaged tickets will not be replaced under any circumstances. Anyone who uses an The Snow League ticket agrees to the provisions set forth in these Ticket Purchase Terms.
- Admission Requirements. To gain entry, each attendee must present a valid, original, undamaged, and unaltered ticket at the venue at the scheduled time. Admission may be denied for any reason, including but not limited to misconduct, intoxication, violation of venue rules, or failure to comply with event policies, as determined solely by The Snow League. Attendees must comply with all health and safety protocols established by The Snow League or the venue, including screenings, security checks, or other requirements. Failure to comply may result in denial of entry without refund.
- No Refunds or Exchanges. All ticket sales are final. No refunds, cancellations, or exchanges will be provided, except as expressly stated herein. Discounts or promotions may be offered after the original on-sale date, but The Snow League will not issue refunds or credits for price differences.
- Event Cancellation or Changes.
- Cancellation: If an event is canceled, refunds of the base ticket price may be issued at The Snow League’s discretion. Refund requests must be made within 10 business days of the scheduled event date.
- Rescheduling: If an event is rescheduled, the original tickets will remain valid for the new date. Refunds for rescheduled events will be issued only if authorized by The Snow League and must be requested before the rescheduled event occurs. All refund requests must be made within 10 business days of the new event date.
- Weather: The Snow League takes place in mountain locations that may experience sudden and extreme weather changes. Attendees assume all risks related to inclement weather, including event delays or modifications. The Snow League reserves the right to proceed, postpone, or modify events based on weather conditions.
- Recording and Conduct Policy. The use of cameras, drones, video recording devices, or any recording equipment is strictly prohibited at The Snow League’s events unless expressly authorized. Violation of this policy may result in ejection from the event without refund. Additionally, disruptive or inappropriate conduct, as determined by The Snow League, will be grounds for removal from the venue.
- Personal Information. By purchasing tickets, attending events, or interacting with The Snow League, you acknowledge and agree that any information collected by The Snow League or its partners in connection with your purchase, attendance, or participation will be used in accordance with The Snow League’s Privacy Policy, which is available at https://www.thesnowleague.com/privacy-policy. The Privacy Policy explains how we collect, use, share, and protect your information, including any personal data, and outlines your rights regarding the information you provide.
- Filming, Recording, and Appearance Release. By attending events organized by The Snow League, you acknowledge and agree that the event may be filmed, recorded, or photographed for broadcast, livestream, marketing, archival, or other purposes. By entering the event premises, you grant The Snow League and its affiliates, partners, licensees, and assigns the irrevocable right to: (a) record and capture your likeness, image, voice, actions, and statements in any format, including but not limited to video, audio, and photography and (b) use, reproduce, display, distribute, and otherwise exploit such recordings or images for any purpose, including but not limited to marketing, advertising, promotional materials, broadcasts, livestreams, and archival purposes, in any media now known or hereafter developed, worldwide, and in perpetuity. You waive any right to inspect or approve any materials incorporating your likeness and release The Snow League and its affiliates from any claims, including but not limited to claims for compensation, invasion of privacy, or rights of publicity, arising out of the use of your image, likeness, or voice as described herein. If you do not wish to be filmed or photographed, you should not attend the event.
- Indemnity. By purchasing a ticket or attending any event organized by The Snow League, you agree to indemnify, defend, and hold harmless The Snow League, its affiliates, employees, agents, officers, and directors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to: your attendance at the event; your violation of any event rules, terms, or policies; your breach of these terms; or your conduct at the event. Your obligations under this indemnity survive the conclusion of the event.
- Limitation of Liability. You understand and acknowledge that attending an outdoor winter sports event at a mountain venue involves inherent risks and hazards that cannot be eliminated, including slippery or uneven surfaces; variable snow and ice; cold, wind, and sun exposure at elevation; reduced oxygen levels; steep terrain; moving equipment and vehicles (including race or course materials, fencing, snowmobiles, snowcats, and related machinery); cables and rigging; loud or sudden noises; pyrotechnics; flying snow, ice, or debris; crowd movement; and interactions with other spectators. You agree to stay within designated spectator areas and to follow all posted signs and the instructions of The Snow League and venue team members. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU VOLUNTARILY ASSUME ALL RISKS OF INJURY, ILLNESS, PROPERTY DAMAGE, AND LOSS ARISING FROM OR RELATED TO YOUR ATTENDANCE AT ANY THE SNOW LEAGUE EVENT AND HEREBY RELEASE THE SNOW LEAGUE FOR ANY AND ALL LIABILITY OR RESPONSIBILITY FOR ANY PERSONAL INJURY OR DEATH OR PROPERTY DAMAGE OR LOSS OF ANY KIND WHATSOEVER RESULTING FROM YOUR PURCHASE OF A TICKET TO OR ATTENDANCE OF ANY THE SNOW LEAGUE LIVE EVENT. IN NO EVENT SHALL THE SNOW LEAGUE, ITS AFFILIATES, PARTNERS, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE TO YOU FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES OR COSTS EXCEEDING THE GREATER OF (I) THE TOTAL AMOUNT YOU PAID FOR TICKETS TO THE SPECIFIC EVENT OR (II) $100.00. THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF THE SNOW LEAGUE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE. NOTHING IN THESE TERMS WAIVES, RELEASES, OR LIMITS ANY RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
- Arbitration. READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES THE PARTIES TO ARBITRATE THEIR DISPUTES AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM THE SNOW LEAGUE. FOR ANY DISPUTE WITH THE SNOW LEAGUE, INCLUDING WITHOUT LIMITATION ANY DISPUTE OR CLAIM RELATED TO OR ARISING IN CONNECTION WITH YOUR PURCHASE OF A TICKET TO OR ATTENDANCE OF ANY THE SNOW LEAGUE LIVE EVENT, YOU AGREE TO FIRST CONTACT US AT CONTACT@THESNOWLEAGUE.COM AND ATTEMPT TO RESOLVE THE DISPUTE WITH US INFORMALLY. IN THE UNLIKELY EVENT THAT THE SNOW LEAGUE HAS NOT BEEN ABLE TO RESOLVE A DISPUTE IT HAS WITH YOU AFTER SIXTY (60) DAYS, WE EACH AGREE TO RESOLVE ANY CLAIM, DISPUTE, OR CONTROVERSY (EXCLUDING ANY CLAIMS BY THE SNOW LEAGUE FOR INJUNCTIVE OR OTHER EQUITABLE RELIEF AS PROVIDED BELOW) ARISING OUT OF OR IN CONNECTION WITH OR RELATING TO THIS AGREEMENT, OR THE BREACH OR ALLEGED BREACH THEREOF (COLLECTIVELY, “CLAIMS”), BY BINDING ARBITRATION BY JAMS, BEFORE A SINGLE ARBITRATOR, UNDER THE OPTIONAL EXPEDITED ARBITRATION PROCEDURES THEN IN EFFECT FOR JAMS, EXCEPT AS PROVIDED HEREIN. JAMS MAY BE CONTACTED AT WWW.JAMSADR.COM. THIS ARBITRATION AGREEMENT IS MADE PURSUANT TO A TRANSACTION INVOLVING INTERSTATE COMMERCE, AND SHALL BE GOVERNED BY THE FEDERAL ARBITRATION ACT (9 U.S.C. §§ 1–16), AND NOT BY ANY STATE ARBITRATION LAW, TO THE FULLEST EXTENT PERMITTED BY LAW. THE ARBITRATOR HAS EXCLUSIVE AUTHORITY TO RESOLVE ANY DISPUTE RELATING TO THE INTERPRETATION, APPLICABILITY, OR ENFORCEABILITY OF THIS ARBITRATION AGREEMENT, INCLUDING ANY CONTENTION THAT ALL OR PART OF IT IS VOID OR VOIDABLE, EXCEPT AS PROVIDED BELOW. THE ARBITRATION WILL BE CONDUCTED IN NEW YORK, NEW YORK, UNLESS YOU AND THE SNOW LEAGUE MUTUALLY AGREE OTHERWISE, PROVIDED THAT THE PARTIES MAY APPEAR BY REMOTE VIDEO LINK (E.G., ZOOM) IF THEY SO DESIRE. EACH PARTY WILL BE RESPONSIBLE FOR PAYING ANY JAMS FILING, ADMINISTRATIVE AND ARBITRATOR FEES IN ACCORDANCE WITH JAMS RULES, AND THE AWARD RENDERED BY THE ARBITRATOR SHALL INCLUDE COSTS OF ARBITRATION, REASONABLE ATTORNEYS’ FEES AND REASONABLE COSTS FOR EXPERT AND OTHER WITNESSES. ANY JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT OF COMPETENT JURISDICTION. IN ANY ARBITRATION ARISING OUT OF OR RELATED TO THIS AGREEMENT, THE ARBITRATOR MAY NOT AWARD ANY INCIDENTAL, PUNITIVE, INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, AND THE PARTIES WAIVE ANY RIGHT TO RECOVER ANY SUCH DAMAGES. NOTHING IN THIS SECTION SHALL BE DEEMED AS PREVENTING THE SNOW LEAGUE FROM SEEKING INJUNCTIVE OR OTHER EQUITABLE RELIEF FROM THE COURTS AS NECESSARY TO PREVENT THE ACTUAL OR THREATENED INFRINGEMENT, MISAPPROPRIATION, OR VIOLATION OF OUR DATA SECURITY, INTELLECTUAL PROPERTY RIGHTS OR OTHER PROPRIETARY RIGHTS. YOU AGREE TO SUBMIT TO THE PERSONAL JURISDICTION OF THE FEDERAL AND STATE COURTS LOCATED IN NEW YORK, NEW YORK FOR ANY ACTIONS FOR WHICH WE RETAIN THE RIGHT TO SEEK INJUNCTIVE OR OTHER EQUITABLE RELIEF IN A COURT OF COMPETENT JURISDICTION TO PREVENT THE ACTUAL OR THREATENED INFRINGEMENT, MISAPPROPRIATION OR VIOLATION OF OUR COPYRIGHTS, TRADEMARKS, TRADE SECRETS, PATENTS, OR OTHER INTELLECTUAL PROPERTY OR PROPRIETARY RIGHTS. YOU AGREE THAT NEW YORK, NEW YORK IS THE PROPER FORUM FOR ANY APPEALS OF AN ARBITRATION AWARD OR FOR TRIAL COURT PROCEEDINGS IN THE EVENT THAT THE ARBITRATION PROVISION BELOW IS FOUND TO BE UNENFORCEABLE.
- Class Action/Jury Trial Waiver. WITH RESPECT TO ALL PERSONS AND ENTITIES, REGARDLESS OF WHETHER THEY HAVE PURCHASED OR USED A TICKET FOR OR ATTENDED ANY THE SNOW LEAGUE LIVE EVENT FOR PERSONAL, COMMERCIAL OR OTHER PURPOSES, ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION OR OTHER REPRESENTATIVE PROCEEDING. THIS WAIVER APPLIES TO CLASS ARBITRATION, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND THE SNOW LEAGUE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.
